The short version: PixelThat is free. The pictures you make with it are yours, to use however you like, including commercially. Use photos you have the right to use. The app comes as it is, with no warranty. This agreement is with CS42, not with Apple.
These terms are a legal agreement between you and CS42 ("we", "us") covering the PixelThat application for iPhone and iPad (the "App"). By downloading or using the App you accept them. If you do not accept them, do not use the App.
This agreement is between you and CS42 only, and not with Apple Inc. ("Apple"). CS42, not Apple, is solely responsible for the App and its content.
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. The App is licensed to you, not sold.
You keep every right you had in the photos you put into the App, and you own the pixel-art pictures it makes from them. We claim no licence over either, and we never receive them in the first place, because the App does not upload anything. You may use what you make for anything, personal or commercial.
You are responsible for having the right to use the photos you process, including the rights of anyone who appears in them.
The App is free. There are no in-app purchases, no subscription and no advertising. If that ever changes, it will change in a future version, and the version you already have will keep working as it does.
The App has no account system and no server component. Nothing you make is stored by us, so there is nothing for us to lose, restore or hand over. Keeping your own backups of anything important is up to you; pictures you save to your photo library are covered by whatever backup you already use for it.
The App, its name, its icon, its interface and its source code belong to CS42 and are protected by copyright and other laws. These terms give you no rights in them beyond the licence in section 2.
The App includes colour palettes created by others and used as references, with thanks: PICO-8 (Lexaloffle Games), Sweetie 16 (GrafxKid), Endesga 32 (Endesga), and hardware palettes from public references for the Game Boy, Commodore 64, CGA and ZX Spectrum. Face detection and subject separation use Apple's Vision framework. Those names belong to their owners and are used to identify the palettes, not to suggest endorsement.
CS42 is solely responsible for any maintenance and support for the App. Apple has no obligation to provide maintenance or support. Support is by email at hello@cs42.org, offered as best effort with no guaranteed response time.
The App is provided "as is" and "as available", without warranty of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement, to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted or error free, or that a given photo will produce a result you like.
If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you, if any. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are the sole responsibility of CS42.
CS42, not Apple, is responsible for addressing any claims from you or a third party relating to the App or your possession and use of it, including product liability claims, any claim that the App fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
If a third party claims that the App or your possession and use of it infringes their intellectual property rights, CS42, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
You represent that you are not located in a country subject to a United States Government embargo, or one designated as a "terrorist supporting" country, and that you are not listed on any United States Government list of prohibited or restricted parties.
To the fullest extent permitted by law, CS42 is not liable for indirect, incidental, special, consequential or punitive damages, or for lost data or lost profits, arising out of your use of the App. Where liability cannot be excluded, it is limited to the amount you paid for the App, which is zero.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
This licence lasts until terminated. It ends automatically if you break these terms, and you may end it at any time by deleting the App. Sections 4, 7 and 10 to 16 survive termination.
These terms are governed by the laws of the United Arab Emirates, without regard to conflict-of-law rules, except where the mandatory consumer law of your country of residence gives you stronger protection, in which case that law applies to the extent required.
Apple and Apple's subsidiaries are third-party beneficiaries of these terms. On your acceptance of them, Apple has the right (and is deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary.
We may update these terms for a future version of the App. The current version always lives at this address, with the date at the top. Continuing to use the App after a change means you accept it.
